Senate Order 192 on the reporting of Agency Contracts

Murray Motion Reports

The amended Senate Order of 26 June 2003 calls on Australian Government Departments and Agencies to publish a list of contracts for services costing more than $100,000 that either haven't been completed or have been entered into during the previous 12 months. The following information must be given:
  • the contractor, the amount of the contract and the subject matter of the contract
  • the start date and the time the contract will take to complete
  • the relevant reporting period and the 12-month period relating to the contract listings
  • whether each contract calls on parties to keep provisions confidential, or whether there are any other confidentiality requirements
  • a statement explaining reasons for confidentiality
  • an estimate of the cost of complying with this order and a statement of the method used to make the estimate.
The Senate Order requires the letter from the Minister to be tabled twice yearly. No later than the 31 August, in the case of the financial year listing and no later than 28 February (29 in a leap year), for the calendar year listing.

Confidentiality

For the purposes of the above list, “other confidentiality requirements” means where there are any other requirements, which require the provisions of the contract itself, or parts of it, to be kept confidential.

Confidentiality clauses of a general nature are included in all the Agency's standard form contracts, i.e. they all contain clauses requiring the contractor to maintain confidentiality of Commonwealth confidential information and to protect personal information.

Please note: requests by members of the public for access to government information, including details of any of the contracts listed in Senate Order 192 will be considered in accordance with the Freedom of Information Act 1982.

Costs to comply

The total cost of compliance for the Agency for the 2013 Calendar Year compilation would not exceed $1000. This work was performed within the confines of regular duties performed by the Agency Finance Officer. The method used to calculate this estimate was based on the nominal salary level of the staff member involved, the time dedicated to the task and associated on-costs.
